PPAI Privacy Policy

This PPAI Privacy Policy explains how the Promotional Products Association International (referred to herein as “PPAI”, “we”, “us”, “our,” etc.) collects, processes and handles information and personal data provided to us on or through websites, mobile sites, mobile applications, and other digital services and products or services provided, owned, and operated by PPAI with link to or incorporation by reference of this Privacy Policy (collectively, the “PPAI Platforms”).
The PPAI Platforms include, but are not limited to, the following: ppai.org, ppa.org, regionalassociation.org, promotionalproductswork.org, merchmovesus.org, and all other PPAI websites, domains, and mobile applications that incorporate this Privacy Policy.
PPAI is the data controller for the processing of personal data collected by PPAI through the PPAI Platforms. This Policy incorporates by reference and is designed to work with PPAI’s Terms of Use located at https://www.ppai.org/terms-conditions/ and which may be linked or incorporated by reference in the applicable PPAI Platforms.
This Privacy Policy does not apply to other websites or digital platforms that do not themselves link to or incorporate by reference, this Privacy Policy or to third-party websites or digital platforms that may be accessible through any of the PPAI Platforms.
Use of a PPAI Platform that incorporates this Privacy Policy confirms your agreement and consent to the terms of this Privacy Policy. If you do not agree to these terms and conditions, do not use any of the PPAI Platforms that incorporate this Privacy Policy.
Updates to this Privacy Policy are effective when posted. Your continued use of any of the PPAI Platforms following the posting of any changes to these terms shall mean that you have accepted those changes with regard to your use of the PPAI Platforms. You are expected to periodically check this webpage for changes, and it is your obligation to check this webpage for any changes in such frequency as you may decide is appropriate for you.
INFORMATION COLLECTED BY PPAI
PPAI does not collect personally identifiable information from you, other than information that you supply on a voluntary basis. If you choose to provide personal information (such as your name, age, date of birth, mailing address, phone number, email address, credit card number) to sign up for a newsletter, participate in a trade show, event, contest, or other PPAI activity, the information will only be used to support your relationship with PPAI and otherwise as described in this Privacy Policy.
If you do not want personal information to be collected or used by PPAI for purposes described in this policy, you may “opt out,” in the manner described below. However, opting out may prevent your participation in PPAI activities for which personal information is needed.
We collect information through various programmatic and operational activities, including content submissions, contracts, registering for events and webinars, online tools, submitting feedback or requesting more information, subscriptions to our newsletters, participating in programs or events, responding to surveys, attending education sessions, or using any services, apps or tools provided by PPAI and/or its service providers. In addition, we may obtain information from business service providers and marketplaces. For example, vendors that host or maintain our services for us may give us information about your account, address, and transactions. Also, marketplaces that supply our data products may give us information about your account, address, and transactions.
Basic contact information is collected as well as information that is specific to the type of form you complete or the product or service you purchase. Information collected is stored in our database. Profiles generally contain company and individual contact information such as company name, individual name, address, phone, email, website and the products and services associated with your account. In some instances, additional demographic information that you submit may be included on your personal account. If you purchase anything with a credit card or other financial account method, that information will or may be on the order.
When you visit a PPAI Platform, we may use tracking tools like browser cookies, pixels/web beacons, and similar technologies (collectively “cookies”) to automatically collect information about you when you interact with any of the PPAI Platforms or services or emails that we or our service providers may send to you. We may collect information about users over time and across devices when you use the PPAI Platforms. PPAI may engage third parties to collect personal information in this manner way. We may use cookies to aggregate information for analytics reporting. We also use cookies to help us remember and process the items in your shopping cart, understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future.
We may contract with third-party service providers to assist us in better understanding visitors to the PPAI Platforms. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.
Some areas of the PPAI Platforms have a “call to action” using downloads or advertising links that can be clicked. We use pixel tracking to measure the performance of downloads or advertising that are offered.
HOW PPAI USES INFORMATION THAT IS COLLECTED
The information we collect from you may be used in the following manner:
- To present the PPAI Platforms and their contents when they are accessed by you, including any interactive features on the applicable PPAI Platform.
- To provide you with notices about your account or involvement with PPAI or the PPAI Platforms
- To process transactions (Information may be shared with PPAI’s service providers or business partners for the express purpose of delivering the products, goods and services you have purchased or requested.)
- To personalize your experience (Your information helps us to better respond to your individual needs)
- To improve customer service (Your information helps us to more effectively respond to your customer service requests and support needs)
- To improve our website and other of the PPAI Platforms (We continually strive to improve the PPAI Platform offerings based on the information and feedback we receive from you)
- To administer a contest, promotion, survey or other site feature
- To send periodic emails (The email address you provide is used to send you information and updates pertaining to orders, news, events, updates, related product or service information and general PPAI communications. Note: If at any time you would like to unsubscribe from receiving future emails, we include detailed unsubscribe instructions at the bottom of each email. An opt-out or unsubscribe election may take a reasonable amount of time to activate and make effective.)
- To carry out PPAI’s legal obligations and enforce PPAI’s rights arising from any contracts entered into between you and PPAI, including for billing and collection, and if PPAI believes disclosure is necessary or appropriate to protect the rights, property, or safety of PPAI, users of the PPAI Platforms, or others.
- To comply with any court order, law, or legal process, including to respond to any government or regulatory request
- To fulfill any other purpose that PPAI may describe when you provide the information or for which you otherwise consent.
Processing operations may include the recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction of personal data. The personal data we collect about you may be stored for as long as permitted by law following the most recent interaction we have had with you, after which point it may be archived only for so long as reasonably necessary for the purposes set out above, in accordance with applicable laws.
SECURITY OF INFORMATION COLLECTED
We implement a variety of commercially reasonable security measures to maintain the safety of your personal information and to protect it from loss or unauthorized access. Your account information is stored within our database behind security devices and controls. Access to your information is limited to authorized personnel and service providers providing the products and services you have requested or are entitled to receive. PPAI uses industry standard encryption software when collecting or transferring sensitive data such as credit card information. PPAI members also have access to an account through our customer portal http://my.ppai.org. It requires your user identification and password to login. Note: You are responsible for maintaining a secure password and for keeping it confidential.
Online transaction processing containing credit card information is transmitted using Secure Socket Layer (SSL). The data is encrypted and sent to our payment gateway provider.
However, no security system is impenetrable. PPAI cannot and does not guarantee the security of the PPAI Platforms, and PPAI cannot and does not guarantee that the information you supply will not be intercepted while being transmitted by you. The transmission of information via the internet is not completely secure. Any transmission of personal information is at your own risk.
PPAI DISCLAIMS ANY AND ALL LIABILITY FOR ANY CIRCUMVENTION OF ANY PRIVACY SETTINGS OR SECURITY MEASURES CONTAINED ON THE PPAI PLATFORMS BY ANYONE WHO IS NOT UNDER THE AUTHORITY, DIRECTION, OR CONTROL OF PPAI.
DISCLOSURE OF INFORMATION TO THIRD PARTIES
PPAI does not sell or disclose your personal data to third parties without your consent, except as described in this Privacy Policy, including:
- To affiliates and third-party service providers to provide services and information on or through the applicable PPAI Platforms, including online marketing and advertising, and to support our business operations. We require these parties to handle personal data in accordance with this Privacy Policy.
- To affiliates to offer and provide information about related products and services. We do not share personal data from countries that require consent, unless consent has been obtained in advance of sharing with affiliates. We require these parties to handle your personal data in accordance with this Privacy Policy.
- To our distribution channel service providers in connection with the sale and distribution of our products and services. We require these parties to handle your personal data in accordance with this Privacy Policy.
- To governing regulatory authorities or as may otherwise be necessary for us to comply with a legal obligation or demand.
- To accomplish any of the uses described above in the section “How PPAI Uses Information that is Collected.”
We share information with vendors who perform services on our behalf for our business and operational purposes. We may share information with vendors who manage subscriptions or orders, process payments, provide customer support, send emails for us, manage, and operate our services, assist us in our marketing and advertising, including vendors who contribute to our promotional efforts, track advertising impressions, provide analytics services, investigate, and prevent data incidents, audit our records, and provide legal advice. We may also share information with analytics and search engine providers.
Personal information shared with third parties does not include short message service (“SMS”) consent or phone numbers for the purpose of SMS.
Your contact information may be sent to PPAI service providers to help us provide the products and services you have requested or may be entitled, such as for your status as a PPAI member, if applicable.
When you register to attend any PPAI trade show or event your contact information may be provided to exhibiting companies and PPAI’s service providers for the particular trade show or event. During the registration process, you will have the option to decline PPAI’s provision of your information to exhibiting companies. Choosing not to share your information with exhibitors will not affect the process needed to complete your registration. The contact information you submit is processed by PPAI’s third party service providers who assist us in operating the event, conducting our business, or servicing you, so long as those parties agree to protect the information from unauthorized use.
If you are or become a member of PPAI, your contact information may appear in PPAI industry directories, as you decide through the onboarding process or provision of consent for this purpose. PPAI industry directories are non-public and made available to certain of PPAI member categories.
We may also release your information when we believe release is appropriate to comply with the law, enforce our PPAI Platform policies, or to protect rights, property, or safety of PPAI or others.
Third party links
We may include or offer third party products or services on our PPAI Platforms. The terms of use and privacy policies of third party sites are separate and independent from PPAI terms of use and privacy policies. PPAI therefore has no and disclaim any and all responsibility or liability for the content and activities of these linked sites. Nonetheless, we welcome any feedback about these sites so we may protect the integrity of the PPAI Platform.
Surveys & Contests
From time-to-time a PPAI Platform may request information via surveys or contests. Participation in these surveys or contests is completely voluntary, and you may choose whether or not to participate and therefore disclose information that is requested or required for the survey or contest. Information requested may include contact information (such as name and mailing address), and demographic information (such as zip code or age bracket). Contact information is used as necessary to administer the applicable survey or contest, and survey information may be used for monitoring or aggregating research statistics.
DATA PROTECTION
(GDPR) General Data Protection Regulation
To the extent that the EU General Data Protection Regulation (GDPR) applies to PPAI or information that you provide through any of the PPAI Platforms, the following policy statements apply:
If you are an individual in the European Economic Area (“EEA”), it is your right to be informed of and to request a copy of the personal data PPAI holds about you. PPAI also wants to make sure your personal data is accurate and up-to-date. Accordingly, you have a right to rectify or supplement your personal data. Under certain circumstances, you may also have a right to erase, restrict the processing of, transmit, or object to the processing of your personal data. If you would like to access, rectify, erase, restrict, transfer, or object to the processing of your personal data, please contact us as directed below.
Please note that in some circumstances, PPAI may not be able to fully comply with your requests, or PPAI may ask you to provide additional information in connection with your request, if needed to verify your identity or the nature of your request.
PPAI may process your data based upon your consent, when it is necessary for services you request, when it is necessary for compliance with a legal obligation, or for any other lawful basis of processing. For all personal data collected and processed based upon your consent, you have a right to withdraw your consent at any time.
PPAI members seeking to access or update your personal information, change opt in/out selections on your account, request deletion of your information or restrict processing of your information, may do so by logging into http://my.ppai.org to make changes directly to your account. GDPR options are automatically visible if the country code in your address is an EU country. If you are an EU citizen living outside the EU, you can update your EU citizen status in your profile. This will also enable GDPR options on your account. The withdrawal of consent will not or may not affect processing which has already occurred.
If you have additional questions, or concerns, please contact PPAI. If you remain dissatisfied, you may make a compliant with an applicable supervisory authority. PPAI aims to comply with all requirements applicable to your personal information or otherwise with respect to the PPAI Platforms and will cooperate in every reasonable way to achieve that aim.
Canadian Privacy Rights
Residents of Canada may access, review, and request correction of their personal information held by us. We will take reasonable steps to verify your identity prior to responding to your requests. The verification steps will vary depending on the sensitivity of the personal information and whether you have an account with us.
We reserve the right not to change personal information if we disagree that it is incorrect, but we may add your requested alternative information. We may not provide access to personal information where permitted or required to deny access by the applicable law, such as where the information requested would disclose personal information of another individual.
You have the right to refuse to provide or to withdraw your consent to processing of your personal information at any time with effect for future processing. This would not affect processing where the applicable law allows us to process personal information without consent.
Children’s Online Privacy Protection Act Compliance
We strive to comply with the requirements of COPPA (Children’s Online Privacy Protection Act), and we do not knowingly collect any information from anyone under 13 years of age. The PPAI Platforms and PPAI products and services are generally directed to people who are at least 13 years of age.
Intellectual Property
All content included on or within the PPAI Platforms, including, without limitation, text, photographs, images, graphics, illustrations, music, audio clips, video clips, designs, logos, trademarks, data compilations, software, and other materials contained in the PPAI Platforms and/or the selection or arrangement of any of the foregoing, is the sole and exclusive property of PPAI and/or its licensors and is protected by applicable law, including copyright and trademark laws. Unauthorized use of such content is strictly prohibited.
PPAI’s logos, brand identifiers, service marks, and trade dress may not be used by any other party without prior written authorization by PPAI.

State Law Rights
State consumer privacy laws may provide their residents with additional rights regarding use of personal information. Certain states provide (now or in the future) their state residents with certain rights, including rights relating to:

If you are located outside of the United States, please be aware that your information may be processed in the United States, where privacy laws may be less stringent than the laws in your country. By submitting your personal information to PPAI, you agree to the transfer, storage and processing of your information in a country other than your country of residence including, but not necessarily limited to, the United States.

MISCELLANEOUS LEGAL
This Privacy Policy does not create rights enforceable by third parties. If any provision of this Policy is deemed by a court of law or arbiter to be unenforceable or illegal, then such provision shall be deemed severed from the Policy, with all other provisions remaining in full force and effect. This Privacy Policy is governed by and shall be construed in accordance with the laws of the State of Texas, without regard to conflict of law principles of any jurisdiction.
DISPUTE RESOLUTION
Any dispute arising from or related to this Privacy Policy and which is not resolved by informal negotiation shall be submitted to mediation and, if necessary, binding arbitration under then-current rules of the American Arbitration Association (www.adr.org). The mediation and any arbitration shall be conducted exclusively by remote, electronic video means, unless the parties to the dispute agree otherwise in writing. Any in-person mediation or arbitration shall take place exclusively in Dallas County, Texas. Any arbitration award issued by the arbitrator shall be final, binding, and enforceable in any court of competent jurisdiction. The parties to the mediation and any arbitration shall share equally in the fees of the mediator and arbiter, and the party that initiates a mediation or arbitration shall be solely responsible for the paying the initiation fees. Each party shall assume its own costs incurred in regard to the mediation and any arbitration. The prevailing party in any arbitration or court proceeding will be entitled to an award of its reasonable costs and attorney fees incurred as determined by the applicable arbiter or court of competent jurisdiction, together with such other relief as may be awarded in accordance with law and this Privacy Policy.
Changes to the PPAI Privacy Policy
It is PPAI’s practice to post on this page any changes made to this privacy policy. If PPAI makes material changes to how PPAI treats users’ personal information, PPAI may notify you by email, if you specified an email address in your account. The date the privacy policy was last revised is identified at the top of the website page.
You are responsible for ensuring PPAI has an up-to-date active and deliverable email address for you, and for periodically visiting the applicable PPAI Platform or website and this privacy policy to review and understand any changes.
